Retention time
Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Therefore: Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed. Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfil such purposes. Despite any other terms in this Agreement, Whale has the right to deploy data collection technologies and employ machine learning strategies to enhance its artificial intelligence capabilities and the development of its machine learning frameworks linked to the Software and Services. This process involves gathering, synthesizing, and utilizing your usage data, along with other interactions related to the Software and Services. Such data collection extends to the anonymization, pseudonymization, and compilation of personal data into a collective dataset (“Aggregated Data”). By agreeing to these terms, you acknowledge Whale’s exclusive ownership and rights over this Aggregated Data. Whale reserves the unrestricted ability to leverage Aggregated Data for various business objectives, which include but are not limited to: (a) supporting and advancing the functionality and analysis of the Software and Services, encompassing data analytics, performance assessments, optimization efforts, and promotional activities; adhering to legal requirements or contractual agreements; sharing insights on security threats, system vulnerabilities, malicious activities, undesired content, and other technical challenges with its affiliates and partners; and the generation, sharing, and publication of analytical findings and reports based on the Aggregated Data.

Furthermore, it’s crucial to note that Whale does not utilize the specific content you create or document through the Software and Services for the purpose of training its language models or any machine learning algorithms. The content documented and submitted by you remains your property, and Whale is committed to respecting your ownership rights. The integrity of your content is paramount, and under no circumstances will it be used to train our models in a manner that enables other companies to create similar content. Our practices ensure that your unique content contributions are safeguarded and not utilized for training purposes that could benefit competitors or third parties

The User’s Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to possible legal action arising from improper use of this Application or the related Services.The User declares to be aware that the Owner may be required to reveal personal data upon request of public authorities.
