Purpose

This document sets standard operating procedures for confirming decisions reached after a formal disciplinary hearing. It ensures clear, consistent written communication regarding findings, sanctions, required improvements, notice periods, warning validity, and appeal rights.

Scope

This procedure applies to all managers, panel chairs, and HR personnel who conduct disciplinary hearings and issue outcome letters within [Organisation Name].

Pre-Issuance Checklist

Before issuing a disciplinary outcome, [Role] must verify that:

  • A thorough investigation took place before the hearing.
  • The employee received a formal written invitation detailing the allegations and potential sanctions.
  • The employee was informed of their right to companion representation.
  • The sanction matches previous decisions made by [Organisation Name] in similar cases.
  • Deliberations considered active warnings only and ignored expired warnings.
  • Warning durations and appeal deadlines align with [Organisation Name] policy.
  • For dismissals, the decision-maker holds the required authority, notice matches statutory and contractual terms, and final payment and property return details are complete.

Procedure

  1. Adjourn the disciplinary hearing to deliberate after receiving all evidence and employee responses.
  2. Review the investigation report, witness statements, records, and statements made during the hearing.
  3. Decide whether each allegation is upheld, partially upheld, or not upheld. Document the reasoning.
  4. Select the appropriate sanction based on the severity of the misconduct and any live warnings on record.
  5. Draft the outcome letter using the template below. Keep only the applicable decision section.
  6. Send the letter within the timeframe specified in organizational policy following the hearing.
  7. Record the date and delivery method.
  8. Store the letter and case files in the employee’s confidential file.
  9. Log warning expiry dates and appeal deadlines in the designated tracking system.

Decision Categories

  • No Action: Applied when allegations are not upheld or formal action is unnecessary. Issue written confirmation to confirm the matter is closed.
  • First Written Warning: Applied when confirmed misconduct requires formal action. Specifies required improvements and how long the warning remains live.
  • Final Written Warning: Applied for serious misconduct, or continued misconduct while a first written warning is live. States that further misconduct may lead to dismissal.
  • Dismissal with Notice: Applied when misconduct continues while a final written warning is live. Requires compliance with contractual and statutory notice periods.
  • Summary Dismissal: Applied only in cases of gross misconduct as defined in [Organisation Name] policy. Results in immediate termination of employment without notice or pay in lieu of notice.

Delivery and Record Keeping

  • Issue the outcome letter in person, by email, or by recorded post. Log the delivery details.
  • Store the outcome letter, original invitation, hearing notes, and evidence pack in a confidential disciplinary file separate from general personnel records.
  • Disregard expired warnings for future disciplinary decisions once the live period ends.
  • Process any appeal received within the designated deadline without delay. Assign an impartial manager or [Role] to hear the appeal.
  • Retain case records in line with [Organisation Name] data retention policies.

The hearing considered the following allegation(s): [Restate the allegation(s) exactly as presented in the invitation letter].

Having considered the evidence, including [investigation report / witness statements / relevant records] and your statements during the hearing, it has been concluded that [set out findings, specifying which allegations are upheld or not upheld, and the reasons why].

[Select ONE of the following decision paragraphs and remove the remaining four options:]

[Option 1: No Action] It has been decided that no formal disciplinary action will be taken. The allegation is not upheld, and no record of disciplinary action will be placed on your file. [Include details of any informal guidance or clarified expectations if applicable].

[Option 2: First Written Warning] It has been decided that you will receive a first written warning. This warning will remain live on your disciplinary record for [Number] months from the date of this letter, after which it will be disregarded for disciplinary purposes.

[Option 3: Final Written Warning] It has been decided that you will receive a final written warning. This warning will remain live on your disciplinary record for [Number] months from the date of this letter, after which it will be disregarded for disciplinary purposes. You should understand that further misconduct while this warning is live is likely to result in dismissal.

[Option 4: Dismissal with Notice] It has been decided that you will be dismissed with notice. The reason for this decision is [Reason]. Your employment with [Organisation Name] will end on [Date]. You will [work your notice period of [Number] weeks / not be required to work your notice period and instead receive pay in lieu of notice].

[Option 5: Summary Dismissal for Gross Misconduct] It has been decided that your conduct constitutes gross misconduct and that you are summarily dismissed. The reason for this decision is [Reason]. Your employment with [Organisation Name] ends on [Date] without notice or pay in lieu of notice. You will be paid up to your final day of employment, along with any accrued but untaken holiday pay.

[Include for Written Warnings only:] Going forward, you are required to [specify required behavioral improvements] with effect from [Date / Immediate Effect]. [Include details of support, retraining, or supervision provided]. If your conduct does not improve, or if further misconduct occurs while this warning is active, the likely consequence is [a final written warning / dismissal].

[Include for Dismissals only:] Your final pay, including accrued but untaken holiday pay [subject to any permitted contractual deductions], will be paid on [Date]. Please return all property belonging to [Organisation Name], including [keys / uniform / laptop / security pass], to [Role] by [Date].

Right of Appeal You have the right to appeal against this decision. If you wish to appeal, please submit your written appeal stating your full grounds to [Name, Job Title] within [Number] working days of receiving this letter.

The appeal will be heard without unreasonable delay by [Name/Role], who has not previously been involved in this case. You have the right to be accompanied at the appeal hearing by a workplace colleague or a trade union representative. The outcome of the appeal will be confirmed in writing and will be final.
