Scope
This procedure applies to all managers, HR staff, and operational leaders who conduct probation reviews and manage staff departures. It does not cover gross misconduct handled under disciplinary procedures, nor does it cover probation extensions.
Pre-Termination Compliance Checks
Before issuing a probation termination letter, the manager must complete these checks:
- Hold a formal meeting to explain the performance concerns, present the evidence, and give the employee a chance to respond before making a final decision.
- Verify that the personnel file contains solid supporting evidence: onboarding objectives, written logs of interim reviews, and records of training or support provided.
- Confirm the termination does not relate to protected characteristics, pregnancy or maternity, whistleblowing disclosures, health and safety activities, or statutory employment rights.
- Review employment legislation and statutory guidance on minimum service thresholds and unfair dismissal protections.
- Calculate notice periods correctly. Give the employee whichever is longer: contractual notice or statutory minimum notice.
- Check for an explicit pay-in-lieu-of-notice clause in the contract before issuing payment in lieu. Seek HR or legal advice if the contract lacks this clause.
- Confirm whether extending probation is more appropriate if performance evidence is incomplete due to prolonged absence or role changes.
