WARN Act Notice Letter Template

Purpose

This Standard Operating Procedure (SOP) defines the process for complying with the federal Worker Adjustment and Retraining Notification (WARN) Act and equivalent state laws. It details how to issue timely, compliant written notices to affected employees, union representatives, state dislocated worker units, and local government officials before a covered plant closing or mass layoff.

Scope

This procedure applies to all planned facility closings and workforce reductions at [Organisation Name].

Federal WARN Act requirements apply to reductions meeting these criteria:

  • The organisation employs 100 or more employees (excluding part-time employees as defined by statutory rules).
  • Plant Closing: A shutdown of a single site of employment (or one or more facilities or operating units within a site) that causes employment loss for 50 or more employees (excluding part-time employees) during any 30-day period.
  • Mass Layoff: A reduction in force that results in an employment loss at a single site of employment during any 30-day period for either:
  • At least 50 employees who constitute at least 33 percent of the active workforce (excluding part-time employees); or
  • At least 500 employees (excluding part-time employees), regardless of workforce percentage.

State “mini-WARN” laws may impose lower headcount thresholds, longer notice periods, broader coverage criteria, or additional required notice recipients.

Responsibilities

  • Legal Counsel: Reviews coverage calculations, 30-day and 90-day aggregation windows, state requirements, statutory exceptions, and final notice text before distribution.
  • [Role] (e.g., Head of HR / People Operations): Coordinates notice preparation, manages delivery, maintains compliance records, and ensures simultaneous delivery to all mandatory stakeholders.
  • [Role] (Designated Organisation Contact): Answers inquiries from affected employees regarding timelines, final pay, benefits, and support services.

Prerequisites and Pre-Issuance Checks

Before issuing any notice, verify that the designated team completes the following items:

  • Coverage Assessment: Legal counsel formally confirms and documents that the event triggers federal WARN or state mini-WARN statutes, accounting for statutory counting rules and aggregation windows.
  • State Law Reconciliation: Evaluate applicable state labor laws for every location where affected employees work to ensure compliance with stricter state timelines or requirements.
  • Separation Timelines: Finalize specific separation dates or 14-day target windows. Measure the mandatory 60-day notice period from the first day of any 14-day window used.
  • Bumping Rights: Define displacement or bumping rights under organisation policy or collective bargaining agreements.
  • Designated Contact: Name, brief, and prepare a specific [Role] to handle internal and external inquiries immediately upon notice delivery.
  • Companion Notices: Finalize notices for union representatives, state dislocated worker units, and local government leaders for simultaneous service.

Procedure

  1. Assess Coverage and Timelines
  • Evaluate proposed workforce reductions against federal and state statutory thresholds with legal counsel.
  • Calculate the required notice period (minimum 60 calendar days under federal law, or longer if required by state law).
  • Determine whether a statutory exception applies (faltering company, unforeseeable business circumstances, or natural disaster). If an exception applies, draft the required written statement explaining why the team could not give full notice.
  1. Identify Notice Recipients
  • Identify every non-represented employee facing employment loss, including managers, supervisors, and employees who may be displaced through bumping rights.
  • If you cannot identify specific individual separations in advance, target current incumbents in affected positions.
  • For union-represented employees, send notice directly to the chief elected officer of the respective union rather than individual employees.
  • Identify the designated State Dislocated Worker Unit in each state where separations will occur.
  • Identify the chief elected official of the local government unit where the site operates. If the site crosses jurisdictions, select the local government unit that received the highest local tax payments from [Organisation Name] in the preceding tax year.
  1. Draft Mandatory Notices
  • Draft individual employee notices using the approved template below.
  • Draft companion notices for union representatives, state dislocated worker units, and local government officials, verifying that all statutory content requirements are met.
  1. Execute Notice Delivery
  • Distribute notices using a delivery method that guarantees verifiable receipt at least 60 calendar days before the first separation date (or the first day of the separation window).
  • Permitted delivery methods include:
  • First-class mail.
  • Personal delivery with an optional signed acknowledgment of receipt.
  • Insertion into employee pay envelopes.
  • Note: Preprinted standard notices routinely placed in paychecks do not satisfy statutory requirements.
  1. Initiate Support and Companion Reporting
  • Serve companion notices to state dislocated worker units and local government officials at the same time as employee notices to enable rapid response re-employment services.
  • Keep the designated organisation contact available to address employee questions.
  1. Archive Records
  • Assemble a complete compliance file containing the coverage analysis, copies of all issued notices, distribution logs, proof of delivery, and documentation of schedule modifications or corrections.
