US Workplace Mental Health Policy Template

Purpose and Scope

This policy sets out how [Organisation Name] manages workplace mental health, designs work environments to prevent harm, provides access to support services, and processes disclosures and accommodation requests.

It applies to all employees. Managers and supervisors have specific duties regarding workload management and first-line support.

[Role] owns this document. It operates alongside the employee handbook, leave policies, accommodation procedures, and benefits documentation. If entitlement terms overlap, governing employment and benefits policies apply.

Policy Statement

[Organisation Name] treats mental health with the same priority as physical health. We design and manage work to prevent avoidable psychological harm, maintain confidential support channels, and respond to disclosures with practical action.

We commit to:

  • Managing work design, workloads, schedules, and expectations so that chronic overload is resolved as a systemic operational issue.
  • Maintaining current, confidential, and accessible support pathways.
  • Responding to mental health disclosures with active listening, confidentiality, and practical adjustments.

Responsibilities and Work Design

Managers and leaders must design and manage work to protect employee mental health using the following standards:

  • Workload and Staffing: Managers review workloads at [Frequency] and after any team departure. Escalate chronic capacity gaps to [Role] immediately instead of absorbing them through sustained overwork.
  • Scheduling: Publish work rosters [Notice Period] in advance. Teams must agree on schedule changes where possible. Keep out-of-hours communication to exceptional circumstances, following [Communication Guidelines].
  • Role Clarity: Every role requires defined expectations. Managers must provide private, constructive, and timely performance feedback.
  • Workplace Conduct: Address unacceptable behavior, including bullying, harassment, and public humiliation, under the [Conduct Policy].
  • Change Management: Communicate organizational restructures, operational changes, and significant updates early and transparently.
  • Manager Training: Managers complete training at [Frequency] to spot signs of strain, hold initial support conversations, and refer employees to available support options.

Support Pathways

Employees experiencing mental health challenges can access support through any of these confidential pathways without a formal medical diagnosis:

  • Direct Managers or Leadership: Use for local workload adjustments, schedule modifications, temporary duty shifts, or immediate time off.
  • [HR Department / Role]: Use for support options outside your immediate reporting line.
  • Employee Assistance Program (EAP): Confidential counseling and support services available via [Contact Method / Phone Number] for eligible employees and dependents. Usage is anonymous and never reported to [Organisation Name] with identifying details.
  • Health Plan Benefits: Access mental health coverage details via [Benefits Contact / Location].
  • Crisis Assistance: In an immediate crisis, contact external emergency services or crisis lines (such as 988 or 911). Notify [Role] as soon as practical afterward so we can arrange workplace support.

Disclosure and Accommodation Procedure

When an employee discloses a mental health condition or requests a workplace adjustment, follow this procedure:

  1. The manager or recipient listens without diagnosing, acknowledges the situation, asks what immediate support is needed, and agrees on practical initial actions.
  2. Refer the request to [Role] to start an interactive accommodation process in good faith.
  3. [Role] works directly with the employee to evaluate suitable adjustments. Options may include schedule modifications, revised break patterns, workspace changes, adjusted supervision methods, or temporary leave.
  4. Document agreed accommodations and provide them to the employee with clear implementation steps.
  5. If statutory leave or disability rules apply, [Role] coordinates the process to align all relevant entitlement structures.
  6. The manager or [Role] meets with the employee within [Timeframe] to review how well the support is working.

Confidentiality and Non-Retaliation

  • Mental health information is strictly confidential. Share it only with individuals directly coordinating support or accommodations, and only with the employee’s explicit knowledge.
  • Managers receiving disclosures must not discuss details with unauthorized personnel, include them in employment references, or let them negatively impact task assignments.
  • Retaliation against an employee for disclosing a mental health condition, requesting an accommodation, using support services, or taking protected leave is strictly prohibited.
  • Report suspected retaliation to [Role]. We will investigate it under the [Grievance / Conduct Procedure].

Records and Review

  • Keep medical information and accommodation records confidential. Store them separately from general personnel files in [Storage Location] for [Retention Period].
  • [Role] periodically reviews anonymized aggregate data, such as EAP usage rates, absence trends, and exit survey feedback, to track policy effectiveness.
  • Review this policy [Frequency, e.g., Annually], after significant operational changes, or following a major incident.

FAQs on a workplace mental health policy

01What is a workplace mental health policy?

A workplace mental health policy sets out how your organisation manages workplace mental health, designs work environments to prevent harm, provides access to support services, and processes disclosures and accommodation requests.

Having it written down means the same rules apply to everyone, so managers are not making judgement calls case by case under pressure.

02What does a workplace mental health policy include?

This template covers support pathways, disclosure and accommodation procedure and confidentiality and non-retaliation.

Every section is written to be filled in. The bracketed placeholders mark the decisions that are yours to make, such as timescales, approval owners and retention periods.

03How to implement a workplace mental health policy with Whale

Copy this template into Whale and work through the bracketed placeholders so it reflects how your organisation actually operates.

Assign it to the teams it applies to so it sits where people work rather than in a shared drive, and set a review date so it gets revisited on schedule instead of quietly going out of date.
